All images, drawings, art templates, texts, and products shown on this website are provided solely for customer information and reference. All displayed motifs and images are protected by copyright. Downloading or copying any motifs or images is strictly prohibited. Most of the displayed motifs are private commissions and cannot be purchased from NAUBLE or its partners. Only the artworks explicitly listed as available in the Collections section may be purchased.
All displayed motifs are produced on behalf of clients and remain the property of the respective customer or rights holder. NAUBLE creates individual reproductions as custom-made pieces commissioned by clients and delivers them exclusively to the customer or rights holder. 1. General
1.1 The following terms and conditions of NAUBLE LTD apply to all transactions, unless otherwise agreed in writing. The purchaser’s terms and conditions only apply if they have been accepted in writing by NAUBLE LTD. Any counter-confirmation from the purchaser with different conditions is hereby contradicted.
1.2 Offers from NAUBLE LTD are non-committal and subject to change. A contract is only concluded through a written order confirmation or through execution of the order. The content of the written order confirmation or, in its absence, our offer prevails.

2. Pricing
The prices are for deliveries ex works in Hanover. Packaging, shipping costs, applicable sales tax, import duties and any additional costs related to the purchaser’s delivery location are not included.

3. Packaging
Packaging will be charged at cost price and will not be refunded.

4. Time of Delivery
4.1 The stated delivery times are approximate within the scope of the production possibilities and are non-committal. Delivery times begin once the order has been clarified and the required deposit has been received. Any change to the order may result in a delay.
4.3 In case of force majeure, strikes, lockouts or other reasons for which NAUBLE LTD is not responsible, the delivery time will be extended appropriately. In such cases, NAUBLE LTD is entitled to withdraw from the contract in whole or in part.
4.4 NAUBLE LTD is not responsible for delays caused by suppliers or delays occurring after an existing delay.
4.5 Claims for damages by the customer or third parties against NAUBLE LTD are excluded.

5. Transfer of Risk
5.1 Risk is transferred to the customer at the latest when the goods are dispatched. The purchaser must report any transport damage or loss to the transport authorities. For collections by the customer or their representatives, the transfer of risk applies upon handover.
5.2 If shipping is delayed due to circumstances for which NAUBLE LTD is not responsible, risk passes to the purchaser from the day the shipment is notified as ready for dispatch.

6. Assembly
Unless otherwise agreed, commissioning and assembly costs on site will be charged separately, including travel costs. The purchaser ensures free access to the assembly site and that the site is in the agreed condition. The purchaser is liable for delays and/or costs resulting from unusable on-site conditions.

7. Warranties
7.1 Visible defects must be reported to NAUBLE LTD by telephone immediately after receipt of goods, with written confirmation within three days, otherwise the goods are deemed accepted.
7.2 After the goods have been used as intended, complaints are excluded, even for visible defects.
7.3 Goods that become unusable within the warranty period due to a cause predating the transfer of risk, or whose usability has been significantly impaired, will be repaired or replaced free of charge at the discretion of NAUBLE LTD.
7.4 If repair or replacement fails, the customer may demand a price reduction or cancellation of the contract. For contracts referenced in section 12, the right of cancellation is excluded.
7.5 The customer has no further claims, particularly for damages not occurring to the delivered goods. The purchaser indemnifies NAUBLE LTD from third-party claims. The customer is liable for errors in hearing or interpreting telephone instructions. The business language for all processes is English.

8. Terms of Payment
8.1 Upon order confirmation, the customer receives a deposit invoice of 50% of the total order value. It is payable immediately without deductions. Production begins only after receipt of payment.
8.2 NAUBLE LTD is not liable for delays resulting from late deposit payments. Service invoices are payable immediately without deductions.
8.3 After completion of production, a final invoice will be issued, payable upon NAUBLE LTD notifying the purchaser that the order is ready for shipping.
8.4 Goods will only be dispatched after receipt of the full invoice amount. As a rule, the remaining 50% of the order value is due. Exceptional cases may require full advance payment or payment upon delivery.
8.5 For contracts referenced in section 12, in the event of late payment, NAUBLE LTD is entitled to charge default interest of 2% above the Bank of England base rate, unless the purchaser proves lower damage.
8.6 For other contracts, the stated interest claim exists only in case of default and may be reduced if lower damage is proven.
8.7 For contracts referenced in section 12, NAUBLE LTD may withdraw from the contract without granting a grace period if the purchaser’s ability to pay deteriorates significantly or if they are in arrears on previous deliveries. Offsetting against claims of NAUBLE LTD is only permitted with legally established or undisputed claims.
8.8 For contracts referenced in section 12, the purchaser has no right of retention. NAUBLE LTD is entitled to sell receivables to factoring companies.

9. Cancellation / Exchange / Return
9.1 If an order is canceled between the order confirmation and the start of production, a cancellation fee is due. This is at least 30% of the order value. For one-of-a-kind creations, the fee depends on processing status.
9.2 The exchange or return of a unique product is excluded, regardless of the reason, except under warranty regulations in section 7.
9.3 Recycling is subject to a fee and processed like a new order. The client bears recycling costs, transport, customs and other official fees. Refund of residual or metal values is excluded.

10. Retention of Title
10.1 Delivered goods remain the property of NAUBLE LTD until all claims from the business relationship have been fulfilled.
10.2 The customer may only resell goods after all claims from NAUBLE LTD have been paid in full. Otherwise, the customer’s claim against third parties is assigned to NAUBLE LTD. Ownership of unpaid goods cannot be transferred to third parties.
10.3 The customer may neither pledge the goods nor assign them as security.

11. Copyright and License Protection Rights
11.1 If an order involves intellectual property rights, NAUBLE LTD assumes that the customer holds the necessary usage rights. The customer must indemnify NAUBLE LTD from third-party claims.
11.2 Products manufactured by NAUBLE LTD may be published online or in print for promotional use unless the purchaser prohibits this in writing during the order process.
11.3 NAUBLE LTD ensures that customer data or templates are used solely for production and only transferred to suppliers when necessary.
11.4 Confidentiality and project protection obligations apply. The applicable legal framework is the UK GDPR and the Data Protection Act 2018. EU GDPR may additionally apply for EU-based customers.

12. Personal Scope
These conditions apply to contracts concluded with merchants as part of their commercial business.

13. Invalidity of Individual Provisions
Invalidity of one or more provisions does not affect the validity of the remaining ones. Invalid clauses must be replaced by valid ones achieving the intended economic purpose.
